First Tier Tribunal, Judge Findlay This was an appeal by the Claimant, as owner of the Ascot Place Estate, against a decision by the Council to list the Royal British Legion Hall on part of the Estate as an asset of community value. Donford contended that the building was exempt because it could be reached without crossing land owned by anyone else. The Council resisted this on the ground that the exemption should be given a purposive construction so as only to apply if the building was ancillary to the rest of the estate, which the Hall was not. The appeal was allowed, resolving much discussed doubts in previous cases about the scope of the exemption. Tom Jefferies acted for the successful Appellant.
