The High Court has refused to give permission in respect of a proposed judicial review of Royal Tunbridge Wells BC’s decision to grant permission for a new 1,200 seat theatre and office complex in Tunbridge Wells. The scheme is identified as a corporate priority for the Council, delivering the Council’s place-shaping and civic leadership responsibilities for enhancing the attractiveness and cultural vitality of the borough as a whole. David Elvin QC, sitting as a Deputy High Court Judge, rejected the claim as being totally without merit and ordered the claimant to pay all the Council’s costs. Robert Walton acted for the Council.
