The cases covered include major developments in planning, service charges, the growing impact of the Building Safety Act 2022 and the law of nuisance and reflected what was a very busy year for property law and which featured an exceptional number of property cases heard by the Supreme Court.
Taking the number one slot was Fearn v Tate in which Tom Weekes KC and Richard Moules appeared (along with Jacob Dean of 5RB), instructed by Natasha Rees and Sarah Heatley of Forsters LLP, representing the successful flat owners.
Described by EG as “one of the most high profile property law cases of the century let alone just this year” and resulting in a “blockbuster judgment”, the case was described by James Souter of Charles Russell Speechlys in commenting for EG, as “a landmark moment extending the law of nuisance to protect against visual intrusion”.
Also making the top ten are Aviva v Williams in third place with Simon Allison, Brooke Lyne, Justin Bates and Rupert Cohen; Wolverhampton v London Gypsies and Travellers with Richard Drabble KC in fourth place; in seventh spot is Lazari v Secretary of State with Reuben Taylor KC and Sasha Blackmore; in eighth place Merton v Nuffield with Dan Kolinsky KC; Merthyr Tydfill with Rupert Cohen, Justin Bates, Tom Morris placing in ninth; and finally finishing off the EG 2023 round up with AHGR v Kane Laverack with Myriam Stacey KC and Nick Grant.
