Costs issue in the context of a trespass and nuisance case: Omya UK Ltd v Andrews Excavations Ltd [2021] 8 WLUK 111 – application for variation of costs budget, which considered what constituted a significant development for the purposes of under CPR r.3.15A. The unexpected extent of non-party disclosure in a trespass claim for the costs of the removal of waste dumped in a disused quarry had been a significant development which justified the court exercising its discretion to allow the defendants to increase their costs budget. However, the significant development did not warrant a new instruction of leading counsel.
