In a decision dated 26 July 2022, Inspector Janet Wilson dismissed an appeal by McCarthy and Stone against the decision of Arun District Council to refuse planning permission for the above development, which also included a retail store and associated car parking. The inspector found that the proposed development would be harmful to the character and appearance of the area and would cause less than substantial harm to an adjacent Grade II listed building and Conservation Area. Despite the fact that the Council could not demonstrate a five-year housing land supply, the Inspector found that the heritage harm was not outweighed by the public benefits of the scheme and provided a clear reason for refusing permission under paragraph 11(d) of the NPPF. The successful local planning authority was represented at the four-day inquiry by Ben Fullbrook.
