This case concerned a substantial and complex property dispute in relation to the largest brownfield development site in Europe, which was determined at an expedited 6 week trial in the Business and Property Courts. The dispute concerned the claimed existence of many different types of right of way, with express, implied and prescriptive easements being claimed as well as rights based upon proprietary estoppel.
