The Wolverhampton Jurisdiction: Practice alert - Property Case Law Update

Tim Morshead KC draws attention to two recent decisions in the Wolverhampton injunction field: Multiplex Construction Europe Limited v Persons Unknown and Exolum Pipeline System Limited & ORS v Persons Unknown.

The topics addressed are: (1) whether an applicant must apply separately for a "final" order if the Wolverhampton tests were satisfied at an earlier hearing for an application that was labelled “interim”; and (2) an extra requirement likely to be imposed on an applicant asking for longer than the conventional 12 months between reviews.
