Last Friday, the Welsh Ministers made the Morlais Demonstration Zone Order under the Transport and Works Act 1992. The Order grants approval for the world’s first ‘plug and play’ array for the emerging Tidal Stream technology. It is the first demonstration zone of this size for this technology anywhere in the world, and at a maximum capacity of 240MW (subject to phasing) is one of the largest tidal consents in the world. It will be located off the coast of Anglesey. The Inspector’s Report and Decision letter grapple in detail with how to manage phased development for an emerging technology, understanding and assessing its impact on both protected wildlife and AONBs. James Maurici QC and Nick Grant appeared for the successful applicant, Menter Môn. Gwion Lewis QC and Andrew Byass appeared for Natural Resources Wales. Jacqueline Lean appeared for the RSPB.
