International

Landmark has a strong reputation in public advisory and litigation work with an international dimension, and our barristers are called to a range of foreign jurisdictions.

Overview

Landmark barristers regularly act for a range of international clients, including individuals, public interest groups, foreign companies, governments (including government agencies), local government departments and regulatory bodies amongst others.

In addition to litigating significant issues of public international law in domestic courts, our barristers regularly appear in constitutional and human rights appeals before the Privy Council and have experience acting in international tribunals (including the ECtHR and CJEU) and before foreign courts.

A selection of recent work includes:

  • MN v Belgium (Appln No 3599/18): acting in a significant case concerning the limits of extraterritoriality under Article 1 of the ECHR.
  • HF and MF v France (Appln Nos 24384/19 and 44234/20): intervening in an application to the ECtHR by French nationals detained by Syrian Democratic Forces camps in north-eastern Syria following their capture in territory controlled by Islamic State
  • Abdi v UK (2013) 57 EHRR 16: acting in a case before the ECtHR concerning the lawfulness of immigration detention pending deportation
  • Suraj & Ors v AG of Trinidad and Tobago [2022] UKPC 26: appearing before the Privy Council in linked appeals concerning the legality of the domestic Coronavirus Regulations and the scope of the Constitutional legislative savings provisions
  • The Minister of Home Affairs and another (Respondents) v Barbosa (Appellant) (Bermuda) [2019] UKPC 41: appearing before the Privy Council in a constitutional appeal concerning the common law right of abode in Bermuda by virtue of British Overseas Territories citizenship
  • Mauritius Shipping Corporation Ltd v Employment Relations Tribunal and others [2019] UKPC 42: acting in a Privy Council appeal concerning the requirement for ‘promptness’ in judicial review
  • Litigation concerning overseas Sovereign Base Areas, e.g. appearing in the Senior Judges’ Court of the Sovereign Area Base in Cyprus in Antoniades & Ors v Administrator of the Sovereign Base Areas of Akrotiri and Dhekelia, a judicial review concerning the pay of locally employed civilians
  • Filing an application in the Uganda Constitutional Court concerning issues of deforestation
  • Acting in an environmental challenge to drilling by ExxonMobil off the coast of Guyana
  • Drafting and advisory work on domestic constitutions of Guyana, Palestine and Myanmar
  • Trial Observation on behalf of the Bar Human Rights Committee on military courts in the Occupied Palestinian Territories and implications under International Humanitarian and Human Rights Law
  • Advising an NGO on public international law issues arising out a complaint to the African Commission on Human and Peoples’ Rights
  • Advising on the design and implementation of international anti-corruption measures
