Environment

We regularly act for government, regulators, industry, corporate clients and private individuals and groups on wide ranging issue relating to air quality, access to environmental justice (including Aarhus Convention proceedings), waste, contaminated land, pollution, water, noise, climate change, emissions trading, environmental permitting and regulation (including the marine environment), environmental assessment, energy (including renewables), environmental information, utilities, habitats and species protection, nuisance and issues relating to access to the countryside, commons and village greens.

Overview

Members of Landmark have been involved in all of the major environmental cases in the domestic courts, including the following Supreme Court cases:

Manchester Ship Canal Company v United Utilities - private law dispute concerning unauthorised foul water discharges
R (Finch) v Surrey CC - environmental impact assessment of downstream greenhouse gas emissions
R (Friends of the Earth) v Heathrow Airport - challenge to Airports National Policy Statement
R (Mott) v Environment Agency - fishing licence conditions under Article 1 Protocol 1
R (Champion) v North Norfolk DC - habitats appropriate assessment and environmental impact assessment
R (HS2 Action Alliance) v SST - challenge to HS2.

In addition, Landmark members have appeared in many of the leading environmental cases in the Court of Justice of the European Union and before the Aarhus Convention Compliance Committee.

Landmark takes an active role in UKELA (one of our associate members, Lord Carnwath, is its former President) and regularly provides speakers to its annual conferences and a number of members contribute to Garner’s Environmental Law.
